How and when do I pay?
The risk report is free. If you choose to file after reviewing the report and quote, our advisor sends the service agreement and payment instructions by email.
I already have a US trademark. Am I protected in China?
No. Trademark rights are territorial. A US or EU registration does not protect you in China, and China grants rights on a first-to-file basis.
What if my brand name is already registered in China?
Your risk report will show it. If your first choice looks blocked, we screen your backup names and discuss options before you pay anything further.
What if CNIPA objects or refuses the application?
Standard filing covers preparing and filing. Office actions, refusal review and oppositions are outside the standard scope and are quoted in writing before any work starts.
How will I receive filing updates?
Our advisor contacts you by email when there is a filing update or we need more information from you.
How do foreign applicants file a trademark in China?
If you are not based in China, you cannot file directly: the law requires a foreign applicant to entrust a trademark agency established in accordance with law. We act as your single point of contact and the application is filed through that agency.
Can I claim priority from my existing application abroad?
Possibly. If you have already filed the same mark in another country, foreign priority can generally be claimed within 6 months of that first filing. Priority must be declared when the application is filed, and supporting documents submitted by the deadline — tell us before we file.
What documents do I need to provide?
Applicant details, a copy of your business registration or identity document, the brand name and any Chinese version, the classes and goods/services, a specimen if the mark includes a logo or stylised text, and a signed power of attorney — we send you a pre-filled copy.
Do I need to register a Chinese version of my brand name?
It depends on how you use the brand. A Chinese registration does not automatically give you separate rights in the pinyin or the Latin version, and the Chinese, pinyin and English versions are generally assessed separately. If you sell under a Chinese name, a separate filing is usually worth considering — we flag this in your report.
Should I file the mark in colour or in black and white?
Filing a black and white specimen without claiming colour usually gives broader flexibility; filing a colour specimen generally ties protection to that colour. We confirm the approach with you before filing.
How are the classes and the goods or services decided?
China requires goods and services to be filed by class, based on the Nice-based classification. Your report recommends classes and a suggested scope; the final scope is confirmed with you before filing.
Do I need to prove I use the mark in China?
No — proof of use is not required to file. But a registration can be revoked if the mark is not used in China for three consecutive years, so keep records of your use.
Can everything be done in English?
We communicate with you in English about the report, quote, agreement and filing updates. The application itself is filed in Chinese by the agency.
How long does it take to register a trademark in China?
CNIPA must complete examination within 9 months of receiving the application. If the application is approved, it is published for a third-party opposition period (currently 3 months) before registration. Actual timing depends on CNIPA and is not guaranteed.
